Services
DMA Consulting and Assessments offers consulting services and assessments in various areas as detailed on our website and promotional materials. Specific details of each service will be agreed individually with the client.

​Contrating Services

The contracting of our services is formalized by means of a contract or written agreement in which the services to be rendered, the scope of the work, the delivery time, and the cost will be detailed. Any change in the terms of service must be agreed upon by both parties in writing.

Customer Obligations
​
The customer undertakes to provide all the information and documentation necessary for DMA Consulting and Assessments to provide the services in an efficient manner. It also undertakes to comply with the agreed deadlines and payments.
Payment

The fees for our services shall be as set forth in the contract. Payments shall be made according to the agreed terms, which may include advance payments, partial payments or payments upon completion of the service. We reserve the right to suspend or cancel services in the event of non-payment.

Confidentiality
​​
Both parties agree to maintain the confidentiality of information and documents exchanged in the course of providing the services. We will not disclose any confidential information to third parties without the prior consent of the other party, unless required by law.

Intellectual Property
​​
All materials and content developed in the course of providing our services, including reports, analyses and recommendations, are the property of DMA Consulting and Assessments unless otherwise agreed in writing. The client is entitled to use these materials for the specific purposes for which they were provided.

Responsibility
​​
DMA Consulting and Assessments shall not be liable for indirect, incidental or consequential damages that may arise from the use of our services. Our liability is limited to the total value of the services provided under the contract.

Modifications
​​
We reserve the right to modify these terms and conditions at any time. Modifications will be effective upon posting on our website or direct notification to the customer.

Applicable Law
​
These terms and conditions shall be governed by and construed in accordance with the laws of the Republic of Colombia where DMA Consulting and Assessments is incorporated. Any dispute arising out of these terms shall be resolved in the Superior Court of the Judicial District of Cundinamarca.

Annex A. Contracting Online Services

1. Acceptance of Terms
​
By engaging our online services, you confirm that you have read, understood and agree to these terms and conditions and any other related policies or documents that we post on our website. If you do not agree to these terms, you may not use our services.

2. Procurement Process
​
To contract our services online, you must follow these steps:
​​
a. Service Selection: browse our website and select the service you wish to contract. You can find a detailed description of each service on our services page.
b. Review and Confirmation: after completing the form, you will receive a summary of your application and a contract proposal. Please review this proposal carefully. Acceptance of the proposal and confirmation of the details are necessary to formalise the contract.
c. Signing the Contract: once you have reviewed and accepted the terms of the contract, you will receive a link to electronically sign the agreement. The electronic signature has the same legal value as a handwritten signature.
d. Payment: to complete the contract, you must proceed to payment according to the instructions provided. We accept various methods of payment which will be detailed on the website. Payment must be made in accordance with the terms set out in the proposal.

3. Confirmation of Procurement
​
Once you have completed the contracting process, you will receive a confirmation email which will include the contract details and confirmation of receipt of payment. This email constitutes a binding agreement between DMA Consulting and Assessments and the customer.

4. Changes and Cancellations
​​
a. Changes: If you wish to make changes to the scope of service after confirmation of the contract, you must notify us in writing. We will evaluate your request and inform you of any adjustments to the terms or additional costs, if applicable.
b. Cancellations: You may cancel the service before the start date specified in the contract. Cancellations must be notified in writing. Depending on the timing of the cancellation and the terms of the contract, cancellation fees may apply.

5. Customer Responsibility

The customer is responsible for providing accurate and complete information when completing the contracting form. Any errors or inaccuracies in the information provided may affect the provision of the service.

6. Privacy Policy
​​
The personal information you provide when you engage our services will be handled in accordance with our privacy policy. We encourage you to review our privacy policy to understand how we use and protect your information.
7. Dispute Resolution
​​
Any disputes arising from the procurement of online services shall be resolved in accordance with the procedures set out in the ‘Applicable Law’ and ‘Dispute Resolution’ section of these terms and conditions.
